We have just received a letter from our client in Indonesia advising that about 10% or, to be
exact ,9520 gunny(麻) bags have been found broken with a total loss of approximately 4,500 kgs of sugar. According to the Surveyor’s Landing Report, one copy of which is enclosed for your reference, the breakage of the bags is due mainly to the fragility(易碎)of the gunny bags. The Surveyors has further found that the bags are woven with jute (黄麻) of very inferior quality. Therefore, your corporation, instead of either the shipping company or their surer, should be hold responsible for the loss of the goods. In view of the preceding, you are requested to compensate our client in Jakarta for the total loss of sugar at the FAS(船边交货价)value of US $105.00 per ton. Your early settlement of this will be appreciated.

We are in receipt of your letter dated March 20.
For the purpose of assisting you to recommend our products to your clients as early as possible, we agree to your proposal to advance the initial shipment for 1/3 (one third) of the total quantity from May to June. The remaining 2/3 (two thirds) will be shipped during July.
With regard to your request for alteration of the port of destination from Hamburg to Oslo, we wish to say that direct-sailing vessels from here to Oslo are, at present, few and far between, and the transshipment charges in other ports are currently very high. For the sake of avoiding any possible delay and extra expenses caused by transshipment, it is hoped, therefore, that you will comply with original agreement for destination.

We are in receipt of your letter of May 8th with pleasure, inquiring about the matter of reinspection.
For your information, we wish to put forward the following details: Generally, the buyers have the right to re-inspect the goods when they arrive at the port of destination. But for this i tern, it is international practice that the reinspection should be made within 10 days after its arrival, and if any discrepancy (不符) is found, the claim must be raised within 30 days. However, claims which fall within the responsibility of shipping company and underwriters (签名人) shall not be entertained.
We would make it clear that in order to carry out the contract smoothly and eliminate (消除) unnecessary disputes, it is best for the buyer to name the re-inspection agency that shall be approved by both parties and stipulated (规定) in the contract when reinspection is made.
